The Privacy Notice does not address, and we are not responsible for, the privacy practices of any third parties. Data privacy is important to us. This means that we strive to process personal data with due care and in accordance with applicable data protection laws. This Privacy Policy is part of and is governed by our Terms of Service. Keep an eye out for words that are bolded. These words have a specific definition that is included either in this Privacy Policy or in our Terms of Service.

This Privacy Notice (including our Cookie Policy) covers the privacy practices for all of our websites and application platforms, including https://laboriq.co (the “Website”), whether accessed through web browsers, mobile applications or other methods. This Privacy Notice applies to information collected (1) by the Website, whether through passive collection methods or voluntarily delivered by you through data submissions, uploads, posts, emails and other electronic messages, which are made pursuant to this Privacy Notice or (2) in the use or provision of our services, including our LaborIQ™ product and any labor market reports and insights (the “Services”). The Services will include providing electronic downloadable publications in the nature of reports on the labor market, employment, and unemployment management and compensation management. This Privacy Policy will address the following:

  • What choices are available to you regarding the use of your data.

2. From whom is LaborIQ collecting data?
We collect personal data from individuals, such as you, using the Website, our Services, or both (“Users”).

3. What data is LaborIQ collecting from me?
We process “Personal Information,” which includes information that can directly or indirectly identify a particular User. The personal data we collect from Users includes name, address, telephone number, email address and other Personal Information Users provide to us.

Technical Data: We may also automatically collect technical data in relation to Users, such as IP address, browser type and version, preferred language, geographic location, operating system and computer platform, services Users viewed or searched for while using our Services, and parts of our Services that Users have visited. Although we do not normally use technical data to identify individuals, sometimes individuals can be recognized from it, either alone or when combined or linked with user data. In such situations, technical data may also be considered to be Personal Information under applicable law and we will treat the combined data as Personal Information.

Social Media Features and Buttons: The Website includes social media features, such as the Facebook page and Widgets, and the Share button. These features may collect your IP address, which page you are visiting on our Website, and may set a cookie to enable the Feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Website. Your interactions with these features are governed by the privacy policy of the company providing such features.

Analytics: We use mobile analytics software to allow us to better understand the functionality of our Software on your device. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and from where the Software was downloaded.

Push Notifications: We may send you push notifications from time to time in order to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your devices, such as operating system and user identification information.

User Contributions: Users may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Website or transmitted to other users of the Website or third parties for use of Services, including, but not limited to, the Career Life Platform (“User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Please be aware that no security measures are impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

4. How do I opt out? Can I see or change my data?
Users may control the types of notifications they receive from LaborIQ by updating their notification preferences in the Account Settings section of their account. Users can also do the following at any time by contacting us via email at privacy@LaborIQ.co or by phone:

  • Request the User information we have stored;
  • Change/correct any User data;
  • Have us delete any User data we have; and
  • Express any concern you have about use of User data.

5. What does LaborIQ do with my data?
We process personal data for the following purposes:

  • to allow us to run, maintain and develop our business,
  • to allow us to offer and provide our Services,
  • to allow us to provide information, products, or services that Users request from the Website,
  • to allow you to participate in interactive features on our Website,
  • to allow us to perform Services for, and interface with, our customers, suppliers or partners,
  • to enhance our Services and the use thereof,
  • to perform research and analysis relating to our Services,
  • to perform tracking of the use of our Services,
  • to fulfill any other purpose for which the User has provided such personal data, and
  • to detect fraud, e.g. breaches of intellectual property rights.

6. How long does LaborIQ keep my data?
We store User’s Personal Information for as long as the User is using our Services or for as long as we have another purpose to do so and, thereafter, for no longer than is required or permitted by law or necessary for internal reporting and reconciliation purposes. A User is considered to be “using” the Services for as long as the User maintains an account with LaborIQ or on the Website.

If you terminate a subscription, it is our standard procedure to archive your account data (such as usernames and contact information, reports generated and dashboard preferences) for 60 days. However, if you prefer to have your account data deleted upon termination, you can do so by notifying LaborIQ directly.

7. How is LaborIQ protecting my data?
We implement and maintain reasonable and appropriate technical and organizational security measures to protect the personal data we process, from unauthorized access, alteration, disclosure, loss or destruction.

Wherever we collect certain sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of the Web page.

While we use encryption to protect certain confidential information transmitted online, we also employ safeguards to protect your information offline. Only employees and other third parties who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable or other confidential information. The servers on which we store personally identifiable information are kept in a secure environment.

Despite our security measures, should a security breach occur that we believe is likely to result in a risk to the data privacy of Users, we will inform the affected Users and certain other parties, as well as relevant authorities when required by applicable law, about the security breach, as soon as reasonably possible.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do apply commercially reasonable efforts to protect your personal data, we cannot guarantee the security of Users’ personal data transmitted to our Website. Any transmission of personal data is at the Users’ own risk. We are not responsible for the circumvention of any privacy settings or security measures contained on the Website.

8. With whom does LaborIQ share my data?
We only share Personal Information within our organization if and as far as necessary for the purposes specified in this Privacy Notice, and to provide the Services. Our employees and contractors enter into non-disclosure agreements with us as a condition to their having access to your information.

We do not share, sell, license or provide your Personal Information with any third party outside of our organization unless one of the following circumstances applies:

Necessary for the purposes. We may share Personal Information with third parties to the extent our Services foresee such disclosure and Users submit their personal data for that purpose, such as through an address book to create connections and facilitate our Services. We may also share Personal Information with affiliated companies and other service providers in connection with our provision of the Services to you, such as by performing data hosting, direct marketing and customer services. Our agreements with these service providers foresee privacy and security commitments from these service providers that are no less protective than our own commitments described in this Privacy Notice. If our Users provide Personal Information directly to a third party, such as through a link on our website, the processing is typically based on such third party’s notice.

For Legal Reasons. We may share Personal Information with third parties if we have a good-faith belief that their access to and use of the personal data is necessary to: (i) meet any applicable law or governing court order, (ii) detect, prevent or otherwise address fraud, security or technical issues, or (iii) protect the interests, properties or safety of us, our Users or the public, in accordance with the applicable law.

Successor Company. We may share Personal Information with a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which User data is among the assets or business transferred.

Upon User’s consent. We may share Personal Information with third parties for other reasons than those mentioned above if we first obtain the User’s consent to do so. The User has the right to withdraw consent at any time upon proper written notification to ThinkWhy.

9. I am a California resident. What rights do I have?
Users who are California residents may have additional privacy rights, which are described in California Civil Code Section § 1798.83 and § 1798.100, which may from time to time be amended or superseded.

In addition to the rights described in this Privacy Policy, as a California resident, you have the following rights:

  • A User may request access to their Personal Information, free of charge, up to twice per year;

  • We are required to provide the requested information in a portable and easily accessible format within 45 days of the request;

  • In response to such a request, We will disclose to you (a) the categories of Personal Information we collected about you, (b) the categories of sources for the Personal Information we collected about you, (c) our business or commercial purpose for collecting or selling that Personal Information, (d) the categories of third parties with whom we share that Personal Information, (e) the specific pieces of Personal Information we collected about you, and (f) if we sold or disclosed your Personal Information for a business purpose, we must disclose (i) for sales of Personal Information, an identification of the Personal Information categories that each category of recipient purchased and (ii) for disclosure for a business purpose, an identification of the Personal Information categories that each category of recipient obtained;

  • A user may request the deletion of Personal Information that We hold (except in certain cases where We need to retain the Personal Information). Keep in mind that if you have an account with ThinkWhy, We will not be able to delete your data if doing so would prevent offering you our services; and

  • Although ThinkWhy will never sell your Personal Information, you may opt out of having your Personal Information sold.

10. I’m a kid. Can I use LaborIQ?
No. Our Website and Services are not intended for children under 18 years of age. No one under age 18 may provide any information to ThinkWhy. We do not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on this Website or on or through any of its features/register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal data from a child under 18 without verification of parental consent, we will delete that information. 11. How will I know if LaborIQ changes this Privacy Notice?
This Privacy Notice is dated January 1, 2020. We may update this Privacy Notice at any time and from time to time if required in order to reflect changes in our data processing practices, in personal data protection laws or otherwise. It is our policy to post any changes we make to our privacy policy on this Website. If we make material changes regarding our treatment and handling of User personal data, we may also notify Users by email to the email address specified in the User’s account or through a notice on the Website home page. Users are responsible for ensuring we have an up-to-date active and deliverable email address for such Users, and for periodically visiting our Website and this Privacy Notice to check for any changes.
